Training Course Terms & Conditions

 
 

Course bookings and payment

To secure a place on one of our training courses, you must purchase a ticket via Tito (our online ticketing platform connected via our website www.dataorchard.org.uk/courses). We will confirm your booking and keep you updated with news about the course via email.

All our online courses take place on Zoom. Attendees will be required to have access to Zoom via a computer with camera and microphone and stable internet connection.

In exceptional circumstances we can issue invoices. This will incur an additional £30 admin fee. All fees will need to be paid in full at least one week in advance of the course start date.

Cancellations

You may cancel your place on the course by writing to info@dataorchard.org.uk. All cancellations incur a £30 admin fee.

For full-price course bookings:

  • Cancellations made 60 days or more before start date receive a full refund.

  • Cancellations made 30-59 days before start date receive 50% refund.

  • Cancellation made 15-29 days before start date receive 25% refund.

  • Cancellations made with fewer than 15 days before start date receive no refund.

For early bird bookings:

  • Cancellations made 60 days or more before the start date receive a full refund.

  • Cancellations made 30-59 days or more before start date receive a 50% refund.

  • Cancellations made with fewer than 30 days before the start date receive no refund.

Refunds will be processed via BACS transfer within 30 days of confirmation of the cancellation.

Transfer of tickets and non-attendance

Non-attendance will be charged at the full rate.

You may transfer your ticket free of charge to another person up to five days prior to the start of the course. You may not transfer your ticket after the course has begun.

Postponement

If you wish to postpone your course, you may transfer your ticket to the same course on an alternative date, if further dates are available, by writing to info@dataorchard.org.uk.

  • Changes made 30 days or more before the start date of original course are free of charge.

  • Changes made less than 30 days of before the start date of original course will be charged 25% of the course price.

Changes by us

  • We reserve the right to change or reorder course content, as well as the trainer, without notice (though we will do our best to tell you in advance).

  • We may need to change the date of your course or cancel it due to circumstances beyond our reasonable control or because the booking numbers are too low to make it viable. In these cases, we will endeavour to offer an alternative date, you may either rebook for this date or claim a full refund.

Data protection, privacy and confidentiality

Data Orchard is the data controller for the purposes of the Data Protection Act 2018. If you have any queries about the use of your data, please email: info@dataorchard.org.uk

The information you provide when you sign up for one of our courses will be used in accordance with our privacy policy. If you take part in a Data Orchard course you are agreeing that we may use your data for the following purposes:

  • We will use your contact details to send you information about the course you have booked and to request feedback.

  • We may publish your name, job title, organisation and event attended within the participant group.

  • We will use your contact details to send you marketing information about other courses, events, and services we offer. You can unsubscribe from marketing communications at any time.

Except in connection with the activities described above, or where required to do so by law, we will not share your information with any third parties.

  • At the outset of the course, we will share participants’ names, job roles and organisation with other participants. You may choose to share your contact details with other participants of your own volition.

  • Our courses operate under the Chatham House Rule.

Recording, filming and photography

Recording of the trainer, participants or any course content is not permitted without prior consent from all parties present on the course. If consent is given, any party may request the recording is stopped at any time or content is deleted up to and including after the course has finished, which must be acted upon immediately.

If Data Orchard wishes to use quotes, recordings, film, or photography involving course participants, for evaluation or promotional purposes, we will always seek consent prior to any recording and publication.

Intellectual property

Unless we expressly agree otherwise (including any proposal accepted by you) we (or our partners) own all intellectual property in any materials we provide or make available to course participants under this agreement. Neither you nor your delegates (if you transfer your booking to another person) are given any rights over that intellectual property except as set out below.

Participants may refer to course materials we provide to them, purely for their own individual purposes (which includes doing their jobs). You and your delegates are not allowed to copy, share, amend or otherwise use our materials without our express permission. Materials given to participants during courses are the intellectual property of Data Orchard CIC and the contents cannot be used, reproduced, in full or part, without our prior written consent.

In line with Data Orchard’s values we may use openly available materials and resources as part of our training. In these cases, we will adhere to license requirements of the source providers around any attribution, adaptation or sharing, or other terms. In addition, we may choose to produce some course materials under an open license ourselves.

Legal rights, applicable law, and jurisdiction

None of the above terms and conditions affects the course participant’s statutory rights as a consumer. These terms and conditions shall take precedence over any terms a participant may seek to impose and such terms shall not form part of this agreement.

As far as legally permitted, Data Orchard CIC will not be liable for breach of contract, negligence, consequential loss, or otherwise as a result of action taken or not taken on the basis of information or advice provided in a Data Orchard event or training course.

This agreement is made and shall be interpreted in accordance with English Law and subject to the exclusive jurisdiction of the courts of England and Wales.
